A doctor who's charged with showering Anna Nicole Smith with prescription drugs claims he's being targeted because he's gay and of East Indian descent.
Dr. Sandeep Kapoor is charged with conspiracy to provide opiates and sedatives to Smith, who died of an overdose in 2007.
Dr. Khristine Eroshevich and Smith's partner, Howard K. Stern, have also been charged.
Kapoor's attorney claims that this photo of Kapoor, taken at the Gay Pride Parade in West Hollywood in 2005 and published by TMZ, has biased Los Angeles County Prosecutors against her client.
The photo was "the catalyst for the prosecution," said the attorney.
"[There is] abundant evidence that others similarly situated to Dr. Kapoor were not prosecuted in this or comparable cases, and that the District Attorney's Office targeted Dr. Kapoor in order to buttress claims and agendas."
