Gays and lesbians in California won't be able to get married any time soon, at least until the State Supreme Court weighs in on Prop. 8.
LGBT rights advocates and California Attorney General Kamala Harris had asked the 9th Circuit Court of Appeals to lift a stay on an earlier decision. In that decision, Judge Vaughn Walker ruled that the voter-approved ban on same-sex marriage was unconstitutional.
State Supreme Court justices have warned that it might be Christmas before they issue a key legal ruling requested by the 9th Circuit.
LGBT rights advocates argued that it's unfair to expect gays and lesbians to put their lives on hold while the case drags on.
However, supporters of Prop. 8 point out that that the issue will without a doubt end up in the U.S. Supreme Court, and it makes no sense for the law to flip-flop with each lower court ruling.
