Supreme Court places permanent stay on California trial broadcast

Wed. January 13, 2010

Washington, DC - This afternoon the US Supreme Court voted 5-4 to continue the broadcast ban of the trial challenging California's gay marriage ban.

The lawsuit involves Proposition 8, a California ballot proposition banning gay marriage approved by 52 percent of California voters in November 2008. The plaintiffs in Hollingsworth v. Perry contend that Proposition 8 violates the US Constitution.

Justices Breyer, Ginsburg, Sotomayor and Stevens dissented.

The high profile trial began on Monday in the United States District Court for the Northern District of California. Judge Vaughn Walker had issued an order permitting the trial to be broadcast live via streaming audio and video to a number of federal courthouses around the country. A temporary stay had been issued Monday by the Supreme Court.
