A federal judge Thursday granted an emergency request to force Indiana to immediately recognize the marriage of a Munster, Indiana couple who wed in Massachusetts.
U.S. District Judge Richard Young in Evansville granted Niki Quasney and Amy Sandler's request for a temporary restraining order to keep Indiana from enforcing its ban on same-sex marriages against the couple.
The case, Baskin v. Bogan, was filed by Lambda Legal on March 10.
Quasney has stage 4 ovarian cancer and the couple frequently travel far from their home to receive medical treatment as a result of their prior experience with the local hospital suggesting it would defer to state law to determine whether a couple is married, according to Lambda Legal.
The restraining order will last 28 days, at which time another hearing will take place.
