On Wednesday, attorneys for gay dads Oren Adar and Mickey Ray Smith will argue that the two men should be able to have their names put on their son's Louisiana birth certificate.
The dads adopted him under New York State law, so he's legally their son. But the child was born in Louisiana, and under Louisiana law, unmarried parents cannot adopt. So the State of Louisiana refuses to put both their names on his birth certificate.
Louisiana officials told the Wall Street Journal that to put both names on the birth certificate would require them to break their own laws.
The case is being heard by the 5th U.S. Circuit Court of Appeals. Two previous courts have already ruled in the dads' favor, according to the Associated Press.
